Canada prohibits TCEP in PU foam-containing products for children under 3

Canada has recently formally approved measures to prohibit the use of the flame retardant tris-(2-chloroethyl) phosphate (TCEP) in products containing polyurethane foam for young children. The new law will take effect on 24 October 2014.

In December 2012, we advised via SGS SafeGuards number 193/12  of Canada’s proposal to introduce measures to prohibit products intended for children under the age of three years if such products are manufactured with polyurethane (PU) foam-containing TCEP1.

On 23 April 2014, Canada published Regulations Amending Schedule 2 of the Canada Consumer Product Safety Act (CCPSA) in the Canada Gazette to prohibit the use of the flame retardant tris-(2-chloroethyl) phosphate (TCEP) in products containing polyurethane (PU)-foam for children under the age of 3, including but not limited to toys and childcare articles2.

The new law will come into force on 24 October 2014 (6 months after publication in the Canada Gazette, Part II), prohibiting the manufacture, import, advertising or sale of such products.
